Giveaway Terms of Service

Effective Date: May 16, 2026

Quick disclosures: No purchase necessary. Void where prohibited. Unless an individual giveaway says otherwise, prizes are purchased or owned by OldManObserver. If a giveaway is marked AD / CONTEST DISCLOSURE, RSI/CIG-provided prize, or similar language, the prize is provided by Roberts Space Industries and/or Cloud Imperium Games, but the giveaway is run solely by OldManObserver. RSI/CIG provided the prize but is not the sponsor, administrator, or winner selector for the event.

1. Overview

These Giveaway Terms of Service ("Terms") govern participation in promotions, contests, sweepstakes, prize draws, subscriber appreciation drawings, and other giveaways ("Giveaways") hosted by OldManObserver on this website, Twitch, YouTube, Kick, Gleam.io, or other platforms. Participation constitutes acceptance of these Terms and any additional rules posted for an individual Giveaway. If an individual Giveaway has its own rules in the Gleam widget, campaign page, or announcement, those individual rules apply to that specific Giveaway if there is a conflict with these general Terms.

2. Eligibility

• Entrants must satisfy the age, residency, account, and eligibility requirements listed in the individual Giveaway rules or Gleam widget.
• Entrants must have any platform account required for the listed entry method, such as a valid Twitch account, and must not be banned or suspended from the OldManObserver channel or community.
• Entrants must comply with the applicable rules and terms of the platforms used for entry, including Twitch, YouTube, Kick, Gleam.io, Steam, and any prize-delivery platform.
• No purchase, payment, donation, subscription, or paid action is required to enter or win.
• Giveaways are open only where permitted by law and are void where prohibited or restricted.

3. Entry Methods

Active Giveaways may be managed through Gleam.io, directly on stream, or through another clearly identified method. Entry actions may include following a channel, visiting a page, submitting a code, or completing other actions listed in the individual Giveaway. Secret codes may be announced during live streams for bonus entries and may expire or be replaced due to platform limits.

Automated entries, fake accounts, bots, fraudulent activity, attempts to manipulate engagement, or attempts to bypass entry rules may result in disqualification.

4. Prize Source and Sponsor Disclosures

OldManObserver-funded Giveaways: For Giveaways that are not specifically marked as RSI/CIG-provided, the prize is purchased, owned, or otherwise supplied by OldManObserver. Mentions of Star Citizen, Roberts Space Industries, Cloud Imperium Games, game names, ship names, product names, screenshots, or logos are for prize identification and descriptive purposes only unless a specific material connection is disclosed.

RSI/CIG-provided-prize Giveaways: If a Giveaway is marked AD / CONTEST DISCLOSURE, RSI/CIG-provided prize, prize provided by Roberts Space Industries / Cloud Imperium Games, or similar wording, the prize has been provided by Roberts Space Industries and/or Cloud Imperium Games. OldManObserver is solely responsible for running the Giveaway, including entries, winner selection, prize selection, communications, and fulfillment unless the individual Giveaway rules state otherwise. RSI/CIG provided the prize but is not the sponsor, administrator, or winner selector for the event, and RSI/CIG personnel are not involved in executing or preparing the event.

All Giveaways are hosted by OldManObserver and are not sponsored, endorsed, or administered by Twitch, YouTube, Kick, or Gleam.io. Other trademarks, game names, platform names, and product names belong to their respective owners.

5. Bracket Challenge and Prize Selection

• From time to time, entries from an active Gleam.io Giveaway may be drawn to participate in a Bracket Challenge phase.
• Bracket selections may be weighted based on each entrant's number of valid entries.
• Final bracket winners are selected through randomized bracket matchups, with odds proportional to valid entries unless the individual Giveaway rules say otherwise.
• Final bracket winners may advance to a prize-selection phase, where a random draw or announced selection method determines the awarded prize.
• You do not need to be present to win unless a specific Giveaway clearly says otherwise.

6. Prize Pool Management

The prize pool may contain digital goods, game items, merchandise, or other listed prizes. When an item is won, it may be removed from the available prize pool. New prizes may be added, and prizes may be substituted with a prize of equal or greater approximate value if the original prize becomes unavailable, where permitted by law. Prizes are subject to availability and cannot be exchanged for cash or other compensation unless required by law or stated in the individual Giveaway rules.

7. Subscriber Appreciation Drawings

From time to time, OldManObserver may randomly select a current Twitch channel subscriber to receive a prize as a token of appreciation. Subscriber appreciation drawings are separate from public Gleam.io Giveaways, require no additional entry or action beyond being a current subscriber at the relevant time, and do not make purchase, donation, or paid activity a condition for winning a public Giveaway.

8. Winner Notification and Prize Delivery

Winners may be contacted using the information provided through the entry method, Gleam.io, Twitch, email, or another platform used for the Giveaway. Failure to respond within seven (7) days may result in forfeiture of the prize and selection of an alternate winner. Winners are responsible for providing accurate information needed to deliver the prize and for any taxes, fees, account requirements, regional restrictions, or platform requirements that apply.

Some digital prizes require account linking, friend requests, in-game gifting, Steam gift transfer, Star Citizen / RSI account transfer, or another platform-specific delivery method. If a winner does not complete the required delivery steps within seven (7) days after notification, the prize may be forfeited and an alternate winner may be selected.

9. Privacy and Data Use

Giveaway entry and prize-fulfillment information may include names, handles, email addresses, platform account identifiers, entry actions, winner contact information, and other information submitted through Gleam.io, Twitch, email, or the relevant platform. This information is used to administer Giveaways, verify entries, prevent fraud, contact winners, deliver prizes, comply with legal obligations, and maintain records. 10. Fairness and Transparency

Drawings are intended to be random and fair. No purchase, donation, subscription, paid action, or paid platform feature improves the chance of winning a public Giveaway unless a lawful, clearly disclosed subscriber appreciation drawing is being conducted separately. For Gleam.io Giveaways, odds of winning depend on the number of eligible entries received and the rules of the specific campaign.

11. Relationship to Gleam.io and Other Platform Rules

Each individual Giveaway hosted through Gleam.io or another platform may include its own official rules, entry conditions, eligibility requirements, start and end dates, prize details, and privacy notices. In the event of a conflict, the individual Giveaway rules govern only for that specific Giveaway, while these Terms continue to apply to all other Giveaways and general policies.

12. Changes, Suspension, and Cancellation

OldManObserver reserves the right to modify, suspend, or cancel any Giveaway if fraud, technical problems, platform issues, prize unavailability, legal concerns, or other causes compromise the integrity or lawful operation of the Giveaway. These Terms may be updated at any time. Updated versions will be posted on this website, and continued participation in future Giveaways constitutes acceptance of the revised Terms.
